Provisions of the 2026 Amendment Bill:

Transgender Rights (Protection of Rights) Amendment Bill 2026

  1. The Bill deletes the right to “self-perceived gender identity” a cornerstone of the 2014 Supreme Court NALSA judgment.
  2.  To obtain a certificate of identity, individuals must now be examined by a government-appointed medical board ( Also known as the “authority”) headed by a Chief Medical Officer.
  3. The definition of “transgender” is narrowed to specific biological markers or traditional socio cultural identities such as Hijra, Kinner, Aravani and Jogta . It explicitly excludes “different sexual orientations and self-perceived sexual identities”.
  4.  The Bill introduces graded punishments for crimes against transgender persons
    • Abduction or grievous hurt to force a person into a transgender identity will face 10 years to life imprisonment
    • Forced begging or servitude one will face 5 to 14 years imprisonment
  5.  Medical institutions performing gender-affirming procedures must now report these details to the District Magistrate.
  6.  Recognised individuals are entitled to change their first name on birth certificates and other official documents based on the new identity certificate..

Opposition & Their Arguments :

  1. The government argues a “precise definition” is necessary to prevent misuse of benefits and ensure they reach the most marginalized individuals facing severe social exclusion due to biological reasons
  2.  Members from Congress, DMK, NCP and TMC termed the Bill “regressive” and “unconstitutional”.
  3. They argued it:
    • Violates the right to dignity and bodily autonomy under Articles 14, 15, 19 and 21 of the Constitution.
    • Pathologises identity by requiring medical invasive examinations

 Transgender activists and LGBTQIA+ groups have staged nationwide protests (including at Jantar Mantar and Pune), calling for the Bill’s withdrawal.
