Supreme Court Allows Minor’s 31-Week Pregnancy Termination

On April 24, 2026, the Supreme Court of India allowed a 15-year-old girl to terminate her 31-week pregnancy, The bench, led by Justice B.V. Nagarathna and Justice Ujjal Bhuyan, emphasized that reproductive choice is a fundamental right under Article 21 of the Constitution..

Key Legal Grounds used in Judgement

1. : The court ruled that no woman, especially a minor, should be compelled to continue an unwanted pregnancy against her will..
2.  Denying the termination was seen as a violation of the minor’s right to live with dignity, as it would cause “irreversible consequences” to her mental and physical health..
3. The court noted that the minor had twice attempted to end her life and that the “best interests” of the minor must take precedence over the statutory 24-week limit under the Medical Termination of Pregnancy (MTP) Act..

Procedure and Safeguards must be

1. The procedure was directed to be carried out at AIIMS Delhi with all necessary medical safeguards..
2. Since the petitioner is a minor, the court required an undertaking of consent from her legal guardian..
3. Justice Nagarathna observed that fear and lack of awareness often prevent minors from reporting pregnancies before the 24-week mark ..
